These Terms of Service (“Terms”) govern your access to and use of LinkTaps (the “Service”). The Service is owned and operated by OutdoorSavannah LLC, a Minnesota limited liability company (“OutdoorSavannah”, “we”, “us”). By using LinkTaps, you agree to these Terms. If you do not agree, you should not use the Service.
1. Using LinkTaps
You must be old enough to enter into a binding contract where you live (usually 18 or older) to use LinkTaps. You are responsible for anything that happens under your account, so you should keep your login details secure and let us know if you suspect any unauthorized use.
We may change, suspend or discontinue parts of the Service at any time. We may also suspend or end your access if we reasonably believe you are breaking these Terms or putting the Service or other users at risk.
2. Your content, links, and domains
“User Content” means anything you submit, upload or configure through the Service. That includes links, profile pictures, usernames, text, and any configuration related to domains, including custom domains and subdomains.
You retain whatever rights you have in your User Content. You are solely responsible for it. That includes being responsible for what your links point to, what appears on or through any domains you connect to the Service, and making sure your use of LinkTaps complies with applicable laws and does not violate anyone else’s rights.
You promise that you either own your User Content or have all necessary rights to use it in connection with the Service. In particular, for profile pictures and other media, you confirm that you have the right to upload and display the content, and that you are not infringing or misusing any copyright, trademark, privacy or publicity rights.
If you connect a custom domain or subdomain to LinkTaps, you confirm that you control it or are properly authorized to use it this way. You are responsible for your DNS configuration, SSL/TLS setup, and any consequences of misconfiguration or downtime. We do not control or monitor what is served from your custom domain.
You agree not to use LinkTaps to do anything unlawful, misleading, harmful or abusive. That includes linking to illegal content, spreading malware or phishing pages, sending spam, harassing others, or attempting to interfere with or overload our systems.
We do not review your links or content before they go live. We may, however, remove content, disable links, or suspend or terminate accounts if we believe they violate these Terms, applicable law, or create risk for us or others.
3. License you grant to operate the Service
To run the Service, we need limited permission to use your User Content.
By submitting or making User Content available through LinkTaps, you grant LinkTaps a worldwide, non‑exclusive, royalty‑free, sublicensable and transferable license to host, store, reproduce, display, adapt, modify (for technical or formatting reasons), and distribute your User Content, but only as needed to operate and improve the Service.
This license allows us, for example, to store and serve your profile picture, show your links and pages to visitors, create backups, and make the technical copies necessary to keep the Service functioning. We are not asking for a broad, separate right to use your content in marketing outside of what is needed to provide and improve the Service.
If LinkTaps is ever involved in a merger, acquisition or similar transaction, this license and your account may be transferred to the new owner so they can continue providing the Service on the same terms.
This license lasts as long as your User Content is available through the Service. Copies may remain in backups, caches and logs for a reasonable period after deletion.
4. Our rights
The Service itself, including the software, design, branding, and other elements (other than User Content), is owned by LinkTaps or our licensors and is protected by intellectual property laws. These Terms do not transfer ownership of the Service to you.
You may use the Service only as permitted by these Terms and applicable law. You may not copy, modify, distribute, sell or lease any part of the Service, nor reverse engineer or attempt to extract source code, unless the law where you live gives you that right despite these limitations.
5. Disclaimers
We work to keep LinkTaps reliable and secure, but there are some things we cannot promise.
The Service is provided on an “as is” and “as available” basis. To the extent permitted by law, we do not give any warranties of any kind, whether express, implied or statutory. That includes implied warranties of merchantability, fitness for a particular purpose, non‑infringement and any warranties arising from course of dealing or usage of trade.
We do not guarantee that the Service will be uninterrupted, timely, secure or error‑free, or that defects will be corrected. We do not guarantee that using LinkTaps will lead to any particular business outcome, traffic level or revenue.
LinkTaps lets you create and share links and, if you choose, connect custom domains. We do not control or endorse the content of third‑party websites, apps or services that your links point to, or that are served from your custom domains. You access them at your own risk, and you are responsible for complying with any terms and laws that apply to them.
6. Limitation of liability
To the maximum extent permitted by law, LinkTaps and its directors, officers, employees, contractors and agents (collectively, the “LinkTaps Parties”) will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data, goodwill or other intangible losses, arising out of or relating to your use of or inability to use the Service, your links and domains, or any third‑party content or services.
In any case, the total liability of all LinkTaps Parties for all claims arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid to LinkTaps for the Service in the six months before the event giving rise to the claim, or (b) US $50. Multiple claims do not increase this limit.
You and LinkTaps agree that these limitations reflect a reasonable allocation of risk and are a basis on which we are able to offer the Service.
Some jurisdictions do not allow certain exclusions or limitations of liability. In those places, the above limitations will apply only to the extent the law allows.
7. Indemnification
If someone brings a claim against any of the LinkTaps Parties related to your use of the Service, your User Content, your links or any custom domain you connect, your violation of these Terms, or your violation of someone else’s rights or of the law, you agree to defend and indemnify the LinkTaps Parties against that claim. That means you will be responsible for any resulting losses, damages, costs and expenses, including reasonable legal fees.
We will notify you promptly if we become aware of such a claim, allow you to control the defense and settlement (as long as you keep us informed), and cooperate as reasonably requested. You may not agree to any settlement that admits fault on our part or imposes obligations on us without our written consent. We may participate in the defense with our own lawyer at our own expense.
8. Changes to these Terms
We may update these Terms from time to time. If we make changes that are significant, we will provide reasonable notice, for example by posting an updated version on our site or by sending you a message.
If you continue using the Service after changes take effect, you agree to the updated Terms. If you do not agree with the changes, you should stop using the Service.
9. Termination
You are free to stop using LinkTaps at any time. We may suspend or terminate your access to the Service at any time, including if we reasonably believe you have violated these Terms or are using the Service in a way that could cause harm.
If your access ends, certain parts of these Terms will continue to apply, including those related to licenses already granted, ownership, disclaimers, limitations of liability and indemnity.
10. Governing law and disputes
These Terms are governed by the laws of the State of Minnesota, United States, without regard to its conflict of laws rules. Any disputes arising out of or relating to these Terms or the Service will be decided exclusively in the state or federal courts located in Ramsey County, Minnesota, and you agree to submit to the personal jurisdiction of those courts.
